Terms of Service

Welcome to the CLEAN Cause Recovery Running App (the “App”), owned and operated by CLEAN Cause, Inc. (“CLEAN Cause,” “we,” “our,” or “us”). By accessing or using the App, you agree to be bound by these Terms of Service (the “Terms”) and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. If you are under the age of 18, you may use the App only with the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements.

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the App for personal, non-commercial use.

3. User Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. CLEAN Cause is not liable for any loss or damage arising from your failure to maintain the confidentiality of your credentials.

4. Acceptable Use

You agree not to use the App to:

  • Violate any applicable law or regulation;

  • Harass, harm, or intimidate any other user;

  • Upload or distribute any offensive, inappropriate, or harmful content;

  • Impersonate any person or entity or misrepresent your affiliation;

  • Attempt to interfere with the operation or security of the App.

We reserve the right to monitor use of the App and remove or disable access to any user content or accounts that violate these Terms or are otherwise harmful.

5. User Content

You retain ownership of any content you submit, post, or share via the App (“User Content”). By submitting User Content, you grant CLEAN Cause a non-exclusive, royalty-free, worldwide license to use, display, reproduce, modify, and distribute that content in connection with the App and our services. You represent that you have the necessary rights to grant this license.

6. Health Disclaimer

The App is intended for general wellness and community-building purposes only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition. Always consult a healthcare provider before beginning any new fitness program. If you are experiencing a medical emergency, call 911 or seek immediate help from a qualified professional.

7. Privacy

We take your privacy seriously. Please review our Privacy Policy for information on how we collect, use, and protect your data. By using the App, you consent to our collection and use of your data as described.

8. Modifications to the App

We reserve the right to modify, update, or discontinue the App (or any part of it) at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the App.

9. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the App will immediately cease.

10. Disclaimers and Limitation of Liability

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind. To the fullest extent permitted by law, CLEAN Cause disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

In no event shall CLEAN Cause or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the App.

11. Indemnification

You agree to indemnify, defend, and hold harmless CLEAN Cause, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, or expenses (including attorneys’ fees) arising from:
(a) your use of the App;
(b) your violation of these Terms; or
(c) your violation of any rights of another.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Travis County, Texas.

13. Changes to These Terms

We may revise these Terms at any time. If we make material changes, we will provide notice within the App or via email. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.
